Well, it's a civil suit, so Greenberg has been ordered to pay Koch what he paid for the wine at the auction is all. The State would have to pursue a fraud charge in a criminal prosecution, which also has a higher burden of proof for him to be "guilty of fraud". That might mean getting, um, cellared for a while by the State.

Punitive damages, if any, are yet to be decided. If some of Greenberg's e-mails that I saw were entered into evidence, I would expect substantial punitive damages.

Greenberg's standing in the community of super-elite price drinkers that he once considered his peers is trashed, too, although I expect that occurred some time ago.
 
While not up on the law in NY, it is possible they have a statute similar to FL regarding "civil theft."
If so, an award of attorney's fees may be forthcoming and, from what I glean from the articles I have read, that could amount to $10 million or more.
Pretty expensive juice.

an award of $10,000,000 for attorney's would be absurd.

I agree.
Nonetheless, such statutes are usually written to provide reasonable attorney's fees for the prevailing party. The court would determine what is reasonable.
My point (albeit, poorly stated) was simply that the total amount of the judgment may well exceed the damage award.
