Various CA retailers obviously do ship to NY, and I had not realized they needed a special permission to do so.

So you can legally be both an importer and a retailer but need a special license to ship out of state? It's like NY through the looking glass. I wonder when the state is going to realize they can make a lot more revenue by instituting a New York style three-tier system and taxing every level.

Kermit has some special restrictions on his license due to being both an onsite retailer and an importer, which is a grandfathered license and no longer available. I'm guessing this is part of it.

Those CA retailers use linked but separate business entities for their direct imports (well, probably not Rare Wine Co) AND have no national distribution business as wholesalers themselves, which KLWM does. It's that particular difference between KLWM and the others that probably triggers some "tier" related regulation that prevents KLWM from shipping to NY directly to a consumer. Meaning, KLWM's wholesale business to NY distributors probably, technically precludes the retail shop in CA from direct shipping to consumers there. I'm guessing the State of NY is saying, you can operate on one tier only here, so take your pick.

Come to think of it, I can think of another CA based entity that might actually find (or have already) this becoming an issue too, but at the moment they're possibly too new and too small. It's one of those things that's pretty fucking technical, and that in an already Byzantine system it could go on on a small scale for years and no agency would actually notice. Or not, I must explicitly state that I'm not an expert on the relevant regulations OR know their practices.
